Terms of Sale

1. Introduction

These Terms of Sale ("Terms") govern the sale of products by AERL Pty Ltd (ABN 87 653 916 477) ("AERL", "we", "us", or "our") to customers ("you" or "your"). By placing an order with us, you agree to be bound by these Terms.

2. Ordering and Acceptance

All orders are subject to acceptance by AERL. We reserve the right to decline any order for any reason. When you place an order, you will receive an acknowledgment email confirming receipt of your order. This email does not constitute acceptance of your order. Your order is accepted and a contract is formed when we send you a confirmation email indicating that your order has been processed.

3. Prices and Payment

All prices are in Australian Dollars (AUD) unless otherwise specified and are exclusive of GST (Goods and Services Tax) for Australian customers. GST will be added at the current rate for orders within Australia.

We accept payment by credit card, bank transfer, or other methods as specified during the checkout process. Payment must be received in full before goods are dispatched unless otherwise agreed in writing.

4. Shipping and Delivery

Delivery times are estimates only and may vary. AERL is not responsible for delays beyond our control, including but not limited to carrier delays, natural disasters, or other unforeseen circumstances.

Risk of loss and title for items purchased pass to you upon delivery of the items to the carrier. You are responsible for ensuring that someone is available to accept delivery and for inspecting goods upon receipt.

5. Returns and Refunds

If you are not completely satisfied with your purchase, you may return the product within 30 days of receipt for a full refund of the purchase price, excluding shipping costs. To be eligible for a return, the product must be:

• In the same condition as you received it
• In the original packaging
• Complete with all components and accessories
• Accompanied by the original invoice or receipt

To initiate a return, please contact our customer service department for a Return Authorization Number (RAN) and shipping instructions.

6. Warranty

AERL provides a warranty for our products as specified in the product documentation. The warranty period begins from the date of purchase. To make a warranty claim, you must provide proof of purchase and follow our warranty claim procedure.

Our warranty does not cover damage caused by:

• Improper installation, operation, or maintenance
• Unauthorized modifications or repairs
• Accident, misuse, or abuse
• Normal wear and tear
• External causes such as lightning, power surges, or natural disasters

7. Limitation of Liability

To the maximum extent permitted by law, AERL shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising out of or in connection with the purchase or use of our products.

Our total liability for any claim arising from or related to the purchase or use of our products shall not exceed the purchase price of the product.

8. Intellectual Property

All intellectual property rights in our products, including but not limited to patents, trademarks, copyrights, and designs, are owned by AERL or our licensors. Nothing in these Terms transfers any such rights to you.

You may not reproduce, modify, distribute, or create derivative works based on our products or their components without our prior written consent.

9. Force Majeure

AERL shall not be liable for any failure or delay in performance of its obligations under these Terms due to circumstances beyond its reasonable control, including but not limited to acts of God, natural disasters, pandemic, war, terrorism, riots, fire, flood, explosion, sabotage, labor disputes, or government action.

10. Governing Law

These Terms are governed by and construed in accordance with the laws of Queensland, Australia. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Queensland, Australia.

11. Changes to Terms

We reserve the right to modify these Terms at any time. Any changes will be effective immediately upon posting on our website. Your continued purchase or use of our products after any such changes constitutes your acceptance of the new Terms.
